Applicability and conditions
Our general conditions are applicable to each offer of Petrens & Co BVBA to you as a consumer, being every physical person who, exclusively for non-professional purposes, acquires or uses marketed products or services.

We only deliver in the European Union (we only send non-flowering plants). Below you will find a list of countries where we deliver:

You need to be at least 18 years old to place an order. If you are not 18 years old, we ask you to place an order by your parents or legal guardian. If we notice that a minor has placed an order, we have the right to refuse your order.

Placing an order on our website constitutes an explicit acceptance of our general conditions which are always available on our website.

If you order online, we will send you a copy of the general terms and conditions below in a format that you can save or print, together with the order confirmation or at the latest at delivery.

We reserve the right to unilaterally change the general conditions below, subject to compliance with the applicable laws and regulations. The general conditions that are in force upon receipt of an order will govern the contractual relationship between us.

The consumer does not have the right to withdraw from its purchase.


Offer and order
If an offer has only a limited duration or is subject to specific conditions, we will communicate this explicitly in our offer.

We always describe as complete and accurate as possible what we sell to you and how the ordering process will proceed. The description is in every case detailed enough for you to make a good judgement. If we use images, these will be a true representation of the offered products. The colours in the images on our web shop can differ from the real colours on your screen.

Notwithstanding the fact that the catalogue and website have been compiled with the utmost care, it is still possible that the offered information is incomplete, or contains substantial mistakes, or is not up-to-date.

We are only committed to an obligation of means with regard to the accurateness, actuality or completeness of the offered information. We can in any case not be responsible for substantial mistakes or misprints.

The offer is only valid while stocks last and can at all times be modified or withdrawn.

Your order is complete and the agreement between us is final once we have received the approval from the card issuer for the payment transaction with your credit card. We only accept Visa and MasterCard credit cards. If the card issuer refuses to approve your payment to us, we cannot be responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.

If you want to buy a product, you need to add it to your shopping cart. Afterwards, you give your contact and invoice details. Then you choose your method of delivery: delivery via bpost. In the last step you get an overview page, you accept our general conditions and you confirm your payment by pushing the order button. If you have followed these steps, your purchase is final. We will send you a confirmation of your order via email.

No right of withdrawal
By placing an order according to the general conditions below, you recognize explicitly that the ordered products have been assembled or made following your specifications, are clearly personalised or cannot be returned due to their nature, as they rapidly decay or loose their characteristics, in a way that there can be no right of withdrawal from your purchase, as specified in article VI.53 WER (as defined hereafter).

The price
In the period that we mention in our offer, our prices will not change, except for price changes as a result of changes in VAT rates.

Our prices are inclusive of all taxes, VAT and services. The delivery costs will be added to the purchase price. They will be communicated before checkout in the payment module.

Payment
We only accept the following payment methods: Visa and MasterCard credit cards.
On our website, we only accept payment via the payment modules that are offered by us.

To guarantee a safe online payment and the safety of your personal details, the transaction details encrypted with SSL technology are sent over the Internet. To pay with SSL you do not need special software. 

Conformity and guarantee
We guarantee that our products are in conformity with your order and meet the normal expectations that you can have taking into account the specifications of the product. We also guarantee to you that the products meet all the applicable laws and regulations while placing your order.

Delivery and execution
All products are delivered to the address that you have indicated in your order.

When an article is in stock, it will be delivered to your delivery address within 1 to 10 working days. The delivery period is dependent on the country where the order needs to be delivered. The delivery periods are indicative.

Possible delays at customs are not taken into account.
The periods are valid for deliveries to capitals in the country of destination. For islands and difficult accessible areas you need to add 1 to 3 working days.

General or specific holidays in Belgium or in the country of destination are not taken into account.
We cannot be responsible for not respecting of the indicative delivery periods if these are due to force majeure, like strikes, putsches, disasters, etc.

Deliveries only happen on weekdays: Monday to Friday between 7am and 6pm.

If we cannot deliver on time, we will always warn you before the expiry of the anticipated delivery period. If we do not warn you before, you can withdraw from your purchase without any costs. In each case, we will reimburse you at the latest within 30 days after the termination of the contract.

Our deliveries always happen at our risk.

If the delivered products were damaged during transport, do not correspond to the products that are mentioned on the order note or do not correspond to the products that you have ordered, you need to inform us as soon as possible and at the latest within 3 days and send us the products back within 7 days after receipt. Returns are always at your own cost. You always need a good reason before we can accept a return. Before you return an order, you need to send us an email with this reason. Also mention your order number in your message. You can use the contact form on our web shop for this purpose. If we approve your reason, we will reimburse you the whole amount inclusive of delivery costs. The cost for returning the product is always at your cost. We strive to get back to you at the latest within 4 working days after receipt of your complaint.

We cannot be responsible for any future damage because of late delivery of non-delivery by the transporter who has been appointed by us. Our responsibility is limited to the value of the products for which you can prove that they have not been received by you.

Force majeure
In case of force majeure we are not required to fulfil our obligations. In such case we can either suspend our obligations for the time period of the force majeure or decide to terminate the agreement.

Force majeure is every circumstance beyond our control that prevents the fulfilment of our obligations in whole or in part. This can be, amongst others: strikes, fire, disruptions of businesses, disruptions of energy, disruptions in a (telecommunication-) network or connection or used communication systems and/or the unavailability of our website, non- or non-timely delivery by suppliers or other third parties.

Intellectual property
Our website, logos, texts, photographs, names and in general all our communication are protected by intellectual property rights from us, our suppliers or other claimants.

It is forbidden to use and/or change the intellectual property rights described in this article. For example, you cannot copy or reproduce drawings, photographs, names, texts, logos, colour combinations, etc. without our prior and explicit written approval.

Complaints and disputes
It is possible that your order in our web shop has not gone according to plan. If this is the case, let us know as soon as possible. Complaints always need to be delivered in written form. You can contact us via the contact form on our web shop or via email on info@orchideeen-petrens.be.We will try our best to respond to your complaint within 4 working days.

Belgian law governs all contracts that are made with our clients, despite their residence, and in case of disputes only the courts of Gent are competent. If for reasons of international law another law system is applicable, the interpretation of the current general conditions will be based on the Belgian Code of Economic Law, book VI with regard to market practices and consumer protection, of 31 May 2014 (defined as WER).

Privacy statement
We attach great importance to the fact that the processing of your personal details takes place in a way that is in accordance to applicable laws and regulations.

By giving your personal details on our website, you give us the explicit and unequivocal approval to process these details. Your personal details are only collected and processed with the purpose to give and/or send you the information and publications asked by you. We keep logs of the use of the website on the basis of which statistics are generated for the anonymous analyse of this use. We only process those personal details that are necessary for that purpose.

Your personal details will not be given to third parties.

You have always access to your personal details and you can check them for accuracy or adjust them. You can also ask to have your personal details removed. In that case, you can contact us. This removal can have the effect of not being able to use (a part of) our services anymore.

We reserve the right to modify this privacy statement in accordance to applicable privacy rules.

Taxes (VAT)
All prices at checkout are VAT included. For plants the VAT-rate in Belgium is 6%. For shipping the VAT-rate is 21%. 
All rates are calculated during checkout.
